Re: Somebody Inc. v. Anyone Co., Ltd.
Dear Professor Smith:
As our primary expert witness, please call me at your earliest convenience to advise of
your schedule (to the best of your knowledge) for July, August, September and
October. Although the court has not set a date for the trial of the above-referenced
matter, we anticipate that notice of a trial date is imminent. If the trial date is
incompatible with your schedule, I will need to notify the court and all parties of the
conflict and request a new trial date.
In preparing for your testimony, please bear in mind that, as an expert already
qualified by the Court, you may testify in the form of an opinion or otherwise,
provided that (1) your testimony is sufficiently based upon reliable facts or data, (2)
the testimony is the product of reliable principles and methods, and (3) you have
applied the principles and methods reliably to the facts of the case. Enclosed is a
statement of facts of the case to assist you in preparing testimony. Once we have a
definite date for your court testimony, I will call you to schedule a practice session so
that we can get you fully prepared beforehand.
If you have any questions about the trial, please call me. Thank you for your
cooperation and I look forward to hearing from you.
