建議不要在中國起訴 ZHANG, WANG & LEE, L.L.P. ATTORNEYS AND COUNSELLORS AT LAW 666 EAST CHANGAN BOULEVARD BEIJING, P.R. CHINA 100001 TELEPHONE: 010-1234-5678; TELEFAX: 010-1234-5679 WWW..ZWL.COM.CN VIA CERTIFIED MAIL, RETURN RECEIPT REQUESTED, RESTRICTED DELIVERY May 18, 2004 Mr. Johnson Smith Providence Group, Inc. Suite 618 620 - 5th Avenue New York, N.Y. 10002 The United States of America Re: American Eagle, Inc. v. Anderson Consultants, Inc. Dear Mr. Smith: After careful investigation, research, and deliberation, we have decided that Zhang, Wang & Lee, L.L.P. will no longer be able to represent you regarding the above-referenced matter, if without the assistance of legal counsel in the U.S. Our decision not to handle your case, IN CHINA, is based, among other reasons, upon an enforcement reality. Under current situation, it is highly unlikely that a Chinese court judgment would be recognized and enforced in New York, the home state of the defendant. Furthermore, it is very uneconomical to bring a case to court and to trial in China. It is our professional opinion that the economic costs to bring your claim in China are not justified by the potential value of a judgment or verdict in your favor. You may have your case reviewed by another attorney in China, and I encourage you to do so, because another attorney may view the case differently. Please be advised, however, that, by New York law, you have no more than three years from the date of the incident to file a complaint, if you choose to proceed. Therefore, we strongly encourage you to engage an attorney in New York to proceed with your claim. Your file will be promptly forwarded to your New York counsel at your request. If you have other questions or concerns, I encourage you to contact me so that I may discuss them with you.
