鑒于你們將如期向收貨人交付下列貨物而不要求提交海損保證金，我們，中國人民財產(chǎn)保險股份有限公司北京市直屬支公司，在此保證向你們支付由適格理算人嚴(yán)格根據(jù)運(yùn)輸合同合理，恰當(dāng)?shù)乩硭愕�，�?yīng)由中國聯(lián)合石油有限責(zé)任公司承擔(dān)的下屬貨物應(yīng)分?jǐn)偟墓餐p和/或救助報酬和/或特別費(fèi)用。
In consideration of your delivery in due course of the goods specified below to the consignees thereof without collection of a deposit, we, PICC Property and Casualty Company LTD. Beijing Capital Sub-ranch, hereby undertake to pay to you any contribution to General Average and/ or salvage and/or Special Charges which may hereafter be ascertained by proper Average Adjuster(s) strictly according to the terms of the contract of affreightment to be reasonably and properly due from the consignees in respect of the said goods.
本擔(dān)保函的提供并不表明對責(zé)任的認(rèn)可，也不影響收貨人對本事故應(yīng)當(dāng)享有的抗辯和追償權(quán)利。
The provision of this Guarantee shall not be deemed to be an admission of liability and shall be without prejudice to Consignee’s’ defenses or any rights of recourse in respect of the above incident.
本擔(dān)保函受中華人民共和國法律調(diào)整，所產(chǎn)生的爭議由中國法院管轄。
This Guarantee is subject to Chinese Law and to the exclusive jurisdiction of Dalian Maritime Court.
