Suite 618 620 - 5th Avenue Beijing, China 100012 Dear Mr. Smith: This is a reminder following our telephone conversation yesterday in which you told me that someone anonymous called you regarding the case. Let me restate herewith one very important piece of advice: now that you have me as your counsel in China, do not talk to ANYONE about your case. Use me as the “bad guy” if necessary, and let me know immediately if anyone approaches you to discuss this matter. In particular, any contact with you by the opposing counsel or his representative, without my prior knowledge and approval, is against the law and lawyers’ ethical code. Please be further advised that one official investigator from the Ministry of Commerce buzzed me this morning regarding your internal auditing procedure. Judging from all corners, I anticipate that notice of your appearance before the administrative tribunal is imminent, and I will let you know the logistics and timing of your appearance as soon as possible. Meanwhile, I am enclosing a client manual on testifying before the Ministry of Commerce that I have developed over the years. I also wanted to confirm that we have agreed to meet in my office on January 25, 2005, from 4:00 P.M. to 6:00 P.M., for a preparation session in which we will brainstorm and prepare for the incoming governmental investigation. This time may be rescheduled if necessary. Please bring your subpoena and any documents you think may be related to or useful in our preparation.
