和業(yè)主交涉函 VIA CERTIFIED MAIL May 18, 2004 Mr. Owner Landlord 620 - 5th Avenue New York, N.Y. 10002 The United States of America Re: Lease agreement dated October 1, 2003 Suite 1102 at Sofitell Grand Plaza, 21 South Road, Beijing. Dear Mr. Landlord: Please be informed that this firm represents Iown Al Insurance Co., a tenant of your office building at the above captioned address. I understand that there had been discussions between your representative office in Beijing and Mr. Han Qiang, the office manager of Iown Al Insurance Co., which resulted in the enclosed lease agreement. Notwithstanding the success of these discussions, there remain some areas of concern that your representative office in Beijing has failed to address, causing significant damage to my client’s business. These concerns include: 1. In contradiction of paragraph 7 of the aforementioned lease agreement, your Beijing representative office has failed to pay RMB 4,000.00 per week for the cleaning services. 2. In contradiction of paragraph 8 of the lease agreement, your Beijing representative office has failed to paint the door entering the building, the lobby shared by Authentic Hunan Cuisine and one Din Sum House, and the hallways leading up to the second and third floors. Your representative office also has neglected to replace the broken door handle on the entrance door and repair the hallways leading up to the second and third floors. 3. In contradiction of paragraph 10 of the lease agreement, your Beijing representative office has failed to complete the tiling of the third floor bathroom and replace the cabinet under the sink. Without prejudice to future statement of other concerns, these are the present matters that must be addressed immediately. As you are well aware, my client has been a tenant of your office building for over two years. They always have paid their rent on time and have never neglected their obligations to your Beijing representative office or to you for that matter.
In the spirit of the longstanding amicable relationship that has existed during this period, my client would like these matters taken care of in an expeditious and reasonable fashion. Please give me a call as soon as possible to discuss your time frame for complying with the terms of the lease agreement. If for any reason there is a problem with providing the requirements of the above paragraphs, I will have no choice but to advise my client to contract for the repairs themselves and then deduct those expenses from their rent. I am confident that I can rely on you to fulfill your obligations relating to the lease agreement and to act responsibly in this matter. I look forward to hearing from you soon.
