聘用律師合同（Retaining Agreement）

That I, ( ) have employed ( ) as my attorney to present me to prosecute through settlement or judge certain claims I have and hold against ( ) and /or any all other persons, firms and corporations for or arising out of personal injuries to ( ) as well as damages to property caused by or growing out of a certain accident which occurred on or about the ( ) day ( ) of ( ) 20 ( ) .
我，╳╳╳，特聘請(qǐng)╳╳為我的律師，以代表我提起訴訟并通過(guò)調(diào)解或?qū)徟蟹绞�，就我�?0╳╳年╳月╳日所發(fā)生的事故中所遭受的人身傷害及財(cái)產(chǎn)損失向╳╳、和/或其他任何和所有個(gè)人、商號(hào)和公司提出索賠。
I hereby full authorized and empower my said attorney at law and also in my name, place and stead to bring suit on said claims or any of them, if necessary, and to prosecute the same to final judgement and to compromise and settle said claims or any of them with or without suit in any way or manner that he may deem beat or advisable, giving and granting also unto my said attorney full power to substitute one or more attorneys at law in his place or stead as my attorney in or concerning the premises or any part thereof or in the performance of any or all of the professional services hereunder whether in the trial or appellate court, such other attorneys of attorney to be paid by my above named attorney with no additional expense to me by way of attorneys‘ fees other than hereinafter set out.
在此，我正式授權(quán)我所指定的律師，以我的名義、地位和為維護(hù)我的利益，在必要時(shí)就上述所有或任何一項(xiàng)權(quán)利要求起訴；并委托他以他認(rèn)為最恰當(dāng)?shù)姆绞�，通過(guò)或不通過(guò)訴訟。以調(diào)解或?qū)徟蟹绞�，最終解決我所提出的所有或任何一項(xiàng)權(quán)利要求；我所指定的律師完全有權(quán)聘用一個(gè)或多個(gè)其他律師，以替代他自己在準(zhǔn)備起訴或上訴過(guò)程中，就我提出是全部或任何一項(xiàng)權(quán)利要求，履行全部或部分法律職責(zé)；此種其他律師的費(fèi)用應(yīng)由我指定的律師承當(dāng)，本合同所規(guī)定的應(yīng)由我所支付的律師費(fèi)用不得因此而增加。
In consideration of the services to be rendered to me by my said attorney hereunder, I hereby sell, transfer, assign and convey to my above named attorney or attorneys an undivided interest of ONE THIRD (1/3) interest in and to said claims and amounts received in settlement in the event same is or are settled without suit, and FORTY (40%) per cent of sane and of any judgement obtained or amounts received, on or for such claimed or suits, if same is or are collected by suit or by ───── settlement after suit is filed.
鑒于我所委托的律師按本合同為我提供的服務(wù)，在不經(jīng)起訴而調(diào)解成功時(shí)，我將把三分之一（1/3）的索賠所得，或經(jīng)起訴后再和解或判決時(shí)，把百分之四十（40%）的判決所得或其他所得款項(xiàng)之凈利完全給予以上指定的律師或律師們。
No compromise of my said claimed may be made by said attorney without my consent.
未經(jīng)本人同意，所委托律師不得就我提出的權(quán)利要求達(dá)成任何妥協(xié)。
