    （甲方）因（    ）一案，現(xiàn)委托重慶市第××律師事務(wù)所（乙方）律師出庭代理/代理，經(jīng)雙方充分協(xié)商，訂立合同如下：

    I/We，（    ）（Party A），hereby authorize（    ）in Chongqing（    ）Law Office為（Party B） to appear at the hearings of （    ）v．（    ） on be half of me/us and both parties agree to enter into this agreement there for on the following terms and conditions：

    一、乙方接受甲方的委托，指派律師（    ）為甲方第（    ）審代理人。甲方委托乙方代理權(quán)限是：

    Party B agrees to accepts Party A's delegation and will assign （    ） as Party A's Attorney to appear at the hearings．The power delegated by Party A to Party B is as follows：

    二、律師必須根據(jù)事實(shí)和法律參加訴訟活動(dòng)，認(rèn)真負(fù)責(zé)地履行律師的職責(zé)，維護(hù)委托人的合法權(quán)益。

    The Attorney assigned by Party B shall，based on fact and taking law as his criterion, be actively involved in the litigation and shall neglect nothing in exercising his/her duties and obligations to protect the client's legal rights．

    三、根據(jù)國(guó)家《關(guān)于律師業(yè)務(wù)收費(fèi)標(biāo)準(zhǔn)》的規(guī)定，甲方向乙方支付代理費(fèi)（    ）元，標(biāo)的費(fèi)（    ）元。

    In accordance with the Regulations Regarding Lawyers' Fees，Party A shall pay to Party B $ （    ）as lawyer's fees and  $  （    ）as the fee taxed on the subject matter of the action．

    四、乙方為本案調(diào)查、出庭所需差旅費(fèi)，按國(guó)家規(guī)定標(biāo)準(zhǔn)全部由甲方負(fù)擔(dān)。甲方向乙方支付差旅費(fèi)（    ）元。

    All travel expenses generated by Party B in investigating the case and presenting in the hearing shall be assumes by Party A provided they are within the ambit provided by state laws and regulations，Party A shall therefore pay $ （    ） to Party B as travel fees．

    五、甲方必須真實(shí)地向律師敘述案情，提供證據(jù)。在接受委托后，如發(fā)現(xiàn)甲方捏造事實(shí)，弄虛作假，乙方有權(quán)終止代理，依本合同所收費(fèi)用不予退還。

    The statement made and proofs provided by Party A shall be based on fact． Where Party A should be found fabricating fact，Party B is free to terminate this agreement and payment already collected hereunder shall be retained．

    六、如乙方無(wú)故終止合同，代理費(fèi)和標(biāo)的費(fèi)應(yīng)全部退還甲方；如甲方無(wú)故終止合同，代理費(fèi)和標(biāo)的費(fèi)不予退還。

    Where Party B terminates this agreement without any justifiable reasons，all lawyer's fee and the fee taxed on the subject matter of the action shall be returned to Party A，where Party A cancels this agreement without any justifiable reason，the lawyer's fee and the fee taxed on the subject matter of the action shall be retained by Party B．

    七、如一方要求變更本合同條款，需另行協(xié)議。

    Any modification of this agreement by any party shall be otherwise negotiated by the parties．

    八、本合同經(jīng)甲乙雙方或其代表人簽字（或蓋章）生效。

    This agreement shall take effect where the parties or their authorized representatives set their hands （or seals） hereunto．

    九、本合同有效期限：自簽訂之日起至本案終結(jié)止（判決、調(diào)解、案外和解、撤訴及調(diào)查結(jié)案）。

    This agreement will remain in full force from the date of conclusion till the close of the case （by judgement，settlement，mediation outside the court， withdrawal or investigation）．

    十、本合同一式兩份，雙方各持一份。

    This agreement is made in duplication and each party will hold one．
