RETAINER AGREEMENT – CONTINGENCY
律師聘用協(xié)議--風(fēng)險(xiǎn)收費(fèi)
In consideration of the legal services to be rendered by Zhang, Wang & Lee
(hereinafter referred to as “Law Firm”) for any claim that BMI Inc. of U.S.A.
(hereinafter referred to as “Client”) may have against the parties for default payment
of a debt owed, the Client does employ said Law Firm to commence and prosecute
such claim.
考慮到張王李律師事務(wù)所（下文稱為“律師事務(wù)所”）愿為美國BMI公司（下文稱為“委托人”）提供訴訟
法律服務(wù)以解決相關(guān)債務(wù)糾紛，委托人特此聘用該律師事務(wù)全權(quán)處理有關(guān)法律事務(wù)。
Client agrees to pay, and hereby assigns to Law Firm, a lien of 33% of all amounts
recovered on behalf of Client by settlement before the filing of a lawsuit or other
legal proceedings; 33% of all amounts recovered after the filing of a lawsuit or other
legal proceedings but prior to trial; and 33% of all amounts recovered or awarded
upon trial.
不管在提起訴訟之前雙方達(dá)成庭外和解，還是訴訟提起之后但在審判前雙方達(dá)成和解，仰或是通過庭審判
決得到賠償，委托人同意向律師事務(wù)所支付獲償額的33%作為律師費(fèi)。
All necessary costs and expenses in the prosecution of the case shall be the
responsibility of the Client. If Law Firm advances funds on behalf of the Client for
any costs or expenses, Client agrees to reimburse Law Firm for such advancements.
在案件訴訟過程中的所有必要費(fèi)用都應(yīng)由委托人支付。如果律師事務(wù)所為委托人預(yù)先墊付任何費(fèi)用，委托
人同意償還相關(guān)墊付費(fèi)用。
All expenses and charges of any nature made in conjunction with the case are not
litigation costs and will be paid by Client. In the event of a recovery, Client agrees
that Law Firm may pay any of these unpaid bills from Client’s share of the recovery.
If Client recovers nothing, it is understood that Law Firm is not bound to pay any of
these expenses.
委托人同意因辦理本案所產(chǎn)生的非訴訟費(fèi)用也應(yīng)由委托人支付。在得到獲償賠付的情況下，律師事務(wù)所可
以從委托人應(yīng)得的賠付金額中扣除未付的非訴訟費(fèi)用。如果委托人得不到獲償，委托人也須支付這些費(fèi)用。
Law Firm, in its absolute discretion, may withdraw at any time from the case upon
notice to Client if investigation discloses no basis for further action on behalf of Client,
or if Client fails to cooperate in Law Firm’s prosecution of the case. Associate
counsel may be employed at the discretion and expenses of Law Firm.
如果調(diào)查表明案件無進(jìn)一步訴訟的理由，或委托人在訴訟中不予配合，一經(jīng)通知委托人，律師事務(wù)所有權(quán)
自主決定于任何時(shí)候退出案件代理。
Client agrees not to compromise the claim without Law Firm’s consent and Law Firm
is not authorized to do so without the consent of the Client.

委托人承諾未經(jīng)事務(wù)所的同意不得對(duì)本案作任何妥協(xié)和讓步，且未經(jīng)委托人同意律師事務(wù)所也不得作任何
妥協(xié)和讓步。
The fee for services rendered by Law Firm does not include the perfecting of an
appeal on behalf of the Client or the representation of the Client if an appeal has
been perfected by the adverse party. Fees for appeal shall be subject to
renegotiation between Law Firm and Client.
本合同約定付給律師事務(wù)的法律服務(wù)費(fèi)不包括代理委托人提起上訴或因?qū)Ψ疆?dāng)事人上訴而應(yīng)訴所產(chǎn)生的費(fèi)
用。上訴費(fèi)用應(yīng)由律師事務(wù)所與委托人重新商定。
Client agrees to keep the Law Firm advised of his whereabouts at all times and to
cooperate in the preparation and trial of the case, to appear on notice for
depositions and court appearances, and to comply with all reasonable requests made
of him in connection with the preparation and presentation of this case.
委托人同意隨時(shí)告知律師事務(wù)所其行蹤，在案件準(zhǔn)備和庭審期間參與合作，接到庭外當(dāng)面質(zhì)證和庭審?fù)ㄖ?BR>時(shí)按時(shí)到場，并履行在案件的準(zhǔn)備和庭審過程中對(duì)其的所有合理要求。
Client hereby authorizes Law Firm to provide all information, including doctors’
reports, hospital records, etc., and any and all pictures to the insurance company or
the attorney for the adverse party.
據(jù)此，委托人授權(quán)律師事務(wù)所向?qū)Ψ奖ｋU(xiǎn)公司或律師提供相關(guān)所有信息，包括醫(yī)生的診斷報(bào)告，醫(yī)院的病
例記錄等等，以及任何相關(guān)照片。
NO PRESENTATION HAS BEEN MADE REGARDING WHAT AMOUNT, IF ANY, CLIENT
MAY BE ENTITLED TO RECOVER IN THIS CASE, NOR HAVE ANY WARRANTIES BEEN
MADE REGARDING THE OUTCOME OF THIS MATTER.
律師事務(wù)所并未對(duì)賠付額作任何表述或擔(dān)保，也未對(duì)案件的訴訟結(jié)果作出任何保證。
